With Independence Day right around the corner and summertime beckoning, it’s a good time of year to review your holiday and vacation-leave policies. In New York, for the most part, an employer has the freedom to offer her employees as little or as much of these kinds of benefits as she wants. Most employers provide at least some vacation and holiday pay. When you decide to do that, you need to ensure that your policies are clear and unambiguous, and you must put your policies in writing. In other words, you need a policy that makes sense, is understandable, and is written down.

More Time For Comments On FMLA Revisions

The U.S. Department of Labor has just extended the deadline to submit comments on its proposed additions to the FMLA. The Wage and Hour Division agreed to extend the deadline an additional two weeks, up to and including April 30, 2012.

Do Individual Supervisors Have Personal Exposure for FMLA Violations?

Don’t be surprised if individual supervisors start to appear more often as defendants in Family Medical Leave Act (“FMLA”) lawsuits. Because of a recent decision from the Third Circuit Court of Appeals in Haybarger v. Lawrence County Adult Probation and Parole, the door has opened slightly for plaintiffs to name supervisors in addition to their employer.
